Joseph M. Latino
Joseph M. Latino is Of Counsel to the firm, with extensive background in appeals, motions and hearings at the State and Federal Court levels.
Since beginning his career in 1978 with the Westchester County District Attorney, Mr. Latino has served Westchester County as an Assistant District Attorney and then in 1987 as Deputy Chief of Bureau, Appeals and Special Litigation Division and as Section Chief, Special Litigation Section.
The Special Litigation Section responds to all 28 USC §2254 habeas corpus petitions in the United States District Court, Southern District of New York, arising from convictions prosecuted by the Westchester District Attorney's Office. The Section also responds to any appeals to the U.S. Court of Appeals for the Second Circuit. In this capacity, since assuming the Section Chief role in 1987, Mr. Latino served as either lead counsel or Of Counsel in a supervisory capacity on every response to a Federal habeas corpus petition.
In addition, Mr. Latino has supervised up to four Assistant District Attorneys in the Special Litigation Section, handling all facets of collateral post-conviction litigation in state court, including motions to vacate judgment or set aside sentence pursuant to Article 440 of the Criminal Procedure Law, habeas corpus pursuant to Article 70 of the Civil Practive Law and Rules.
He has also litigated and supervised other matters such as domestic and international extraditions, records access via subpoenas and the Freedom of Information Law, CPLR Article 78 proceedings, and pre-trial motions and direct appeals.
